In order to guarantee responsibility for potential damages that occur during the transport of the products and based on the instructions of the transport companies, we inform you of the following procedures to be followed upon receipt:
- Visually inspect the outside of the package;
-If there are signs of damage to the packaging, you must immediately reject the order and not accept it, under penalty of assuming responsibility for the damage.
- If it is not possible to verify the contents of the package upon receipt, it must be written on the carrier's delivery document "Packaging with damage / Crumpled / torn / wet box, etc.";
- In the event that a small anomaly is detected in the packaging, even if you think you have not damaged the product, it must be written on the carrier's delivery document "Packaging with damage / Crumpled / torn / wet box, etc.";
- If any damage to the product is found when opening the package, it is mandatory to inform it, by e-mail: help@iot-pool.com, within 24 hours after receiving the goods. Everything that was used in the packaging must be kept for later investigation by the carrier and/or supplier and photographs of the product and packaging must be taken.
If this procedure is not followed, ioT-Pool.com reserves the right to decline any responsibility for what happened.
We also inform you that any claim made in this context and which does not appear on the carrier's delivery receipt, the record of anomalies or damage, will not be considered by us.
It is mandatory to have means of unloading at the place of delivery, whether physical or mechanical, to ensure the unloading of the means of transport. The carrier does not unload the goods from the means of transport to the ground.
Transport Conditions
DELIVERY
Proof of delivery will be made by affixing the recipient's signature on the respective delivery sheet, presented by the carrier's distributing driver. If the recipient is a legal person (company), proof of delivery will be provided by the signature of an employee of the company, duly authorized and at the address indicated on the waybill.
The signatures identified above may be replaced by the numerical signature of the recipient, as well as its reproduction, this constitutes proof of delivery of orders. The Carrier and iOT-Pool.com recognize that this type of digital signature has the same value as a traditional paper signature. After 1 (one) year without the orders and goods not delivered and stored at the facilities of the carrier or ioT-Pool.com, being duly claimed or picked up by the recipient, the ownership of the same passes to iot-Pool, which may give the most appropriate destination for them, having the right to be reimbursed with the expenses caused by the storage measures operated.
RESPONSIBILITY
Notwithstanding the foregoing and unless there is an imperative legal provision to the contrary, and also without prejudice to compliance with the procedure relating to claims provided for in clause 7a of these conditions, ioT-Pool.com will only be responsible for partial loss or damage to the goods transported in the event that the recipient has made, upon delivery of the goods by the Carrier, a record of reservations in the respective delivery sheet, which contains any anomalies of the volumes.
If the carrier is unable to unload the goods, for whatever reason, such as the wrong address, improper access, lack of unloading facilities, absence of a recipient or contact person to receive the goods, etc., costs may be incurred. extra delivery. These costs, which in case of return of the goods will not be returned, even in orders with free shipping, the transport value, according to the price lists, will be deducted from the total value of the order.
National Transport
The Carrier/ioT-Pool is responsible for the total or partial loss of the goods or for damage that occurs between the time of collection and delivery. The Carrier/ioT-Pool responds, as if they were committed by itself, for the acts and omissions of its employees, representatives or subcontractors. The responsibility of the Carrier/ioT-Poolit is triggered by the value of the goods on the date it was entrusted to you, by the value of its repair or by the direct costs of reconstituting the documents. The amount of compensation for loss or damage cannot exceed €10 (ten euros) per kg of gross weight of missing or damaged goods, with a maximum limit of €300 (three hundred euros) per order. This compensation limit value per kg only applies in cases where the commercial value of the goods is higher. In other cases, it will always be the commercial value of the goods to determine the amount of compensation due. Compensation for delay in delivery cannot exceed the price of transport and is only due when the interested party demonstrates that it resulted in damage. For delays in delivery, the transport service begins when the collection is carried out and not when it is requested from the Carrier. The responsibility of Carrier/ioT-Pool is excluded if the loss, damage or delay is due to the nature or defect of the goods, the recipient's fault, acts of God or force majeure. The responsibility of the Carrier/ioT-Pool is also excluded when the loss or damage results from the risks inherent in any of the following facts: a) lack or defect of the packaging in relation to the goods which, by their nature, are subject to loss or damage when not are properly packaged; b) handling, loading, storage or unloading of the goods by the sender or the recipient, or by persons acting on their behalf; c) insufficiency or imperfection of the marks or symbols of the volumes.
International Transport
However, for international shipments, if the goods are shipped by plane, the criteria limiting liability set by the Warsaw Convention are applied, i.e. the Carrier/ioT-Pool liability limit is set at 16.5837 DTS per kg, equivalent to €20 per kg.
Delay
ioT-Pool.com undertakes to make every effort to provide the service within the stipulated period. In case of delay in delivery in national or international transport, subject to the application of the legal provisions or regulations in force, the liability of DPD or another carrier is limited to the cost of transport.
Compensable Loss
The Carrier/ioT-Pool cannot be held responsible for intangible or indirect damages, whatever their causes.
Export (non-EU countries)
All orders with destination outside the European Union countries, we consider export, are shipped under the Incoterm DAP (Delivered at Place) with the following responsibilities:
Unloading – Seller
Handling – Seller
Storage – Seller
Customs bureaucracies – Buyer
Import duties – Buyer
Transport within the country of destination – Seller
Insurance in the country of destination – Seller
Unloading of goods – Buyer
Delivery complaints
It is the recipient's responsibility, at the time of delivery, to check that the volume(s) or pallet(s) do not show signs of damage or packaging defect. on the conveyor sheet "package or pallet damaged". Never write "subject to verification".
2- After checking the contents of the packages or pallets, send a claim within 48 hours to help@iot-pool.com, attaching photographs of the damage (volume and article), description of the damaged article(s) and its quantity, together with the order number and/or invoice number.
3- If there is no visible damage, you have 5 days to formalize your complaint to iot-Pool, in writing to help@iot-pool.com, attaching photographs of the damage (volume and item), description of the item(s)( s) damaged and their quantity, together with the order and/or invoice number.
Important note:
If the recipient receives the goods without verifying their status in contradictorily with the carrier or without formalizing the reservations referred to in the previous points, it is presumed that the goods are in good condition and loses the power to raise those same reservations.
